1. Application of Terms

These Terms of Trade apply to all services provided by HD Plumbing and Gas and override any previous agreements. By confirming a job, you accept these terms. HD Plumbing and Gas reserves the right to update these terms as needed, with the latest version available upon request or on our website.

2. Definitions

"HD Plumbing and Gas": Refers to our company, including all successors and associated contractors.
"Client": The person or entity engaging our services.
"Goods": Materials provided as part of our services.

3. Rates and Charges

Standard Charges

Technician-Tradesperson: $86 per hour
Gas fitting Tradesperson: $95 per hour
Apprentice: $75 per hour
Call-Out Fee: $75
Vehicle Service Charge: $1.20 per kilometre travelled
Gas Safety Certificate: $120 per certificate

Additional Charges

Parking/Toll Fees: Reimbursed at cost.
Extended Travel Time: Up to 30 minutes of travel is included; additional time is charged.

4. Appointment Changes and Cancellations

You may reschedule an appointment free of charge. For cancellations, 24 hours' notice is required; otherwise, a cancellation fee may apply.

5. Payment Terms

Payment on Completion: For callouts and small jobs, payment is due upon job completion.
Deposit Requirements: Certain jobs require a deposit; work will only commence once the deposit is received.
Progress Payments: For ongoing or large projects, progress invoices are issued to cover labour and materials to date, which are due upon receipt.
Overdue Payments: Accounts overdue by 20 days may incur a $100 late fee. Monthly interest of 20% may be added to overdue balances. We reserve the right to charge collection fees if unpaid invoices require debt recovery.

6. Unpaid Accounts and Enforcement

HD Plumbing and Gas reserves the right to:

Cease Further Work: If payment terms are unmet, we may halt further work until accounts are settled.
Repossession of Goods: For unpaid accounts, we retain ownership of goods and reserve the right to retrieve them. You consent to HD Plumbing and Gas accessing the premises for this purpose if necessary.

7. Risk and Ownership of Goods

Ownership of goods remains with HD Plumbing and Gas until full payment is received. Risk transfers to the client upon delivery, including insurance responsibilities for any damages, loss, or theft from the delivery point onward.

8. Force Majeure

HD Plumbing and Gas is not liable for delays or inability to complete work due to circumstances beyond our control, including but not limited to natural disasters, strikes, or government actions. In such cases, we may suspend or cancel the work without liability.

9. Indemnity

The client agrees to indemnify and hold HD Plumbing and Gas harmless against any claims, damages, or losses resulting from the client’s negligence, actions, or misuse of our services.

10. Termination

Either party may terminate this agreement if the other party breaches the terms or repeatedly fails to meet obligations, including payment. Upon termination, all outstanding amounts owed to HD Plumbing and Gas become immediately due.

11. Intellectual Property

All designs, plans, and intellectual property provided by HD Plumbing and Gas remain our property unless expressly transferred. These materials may not be reproduced or distributed without our written consent.

12. Use of Subcontractors

HD Plumbing and Gas may engage subcontractors to complete certain services. The client agrees that subcontracted services are part of our agreement.

13. Health and Safety

The client agrees to provide a safe working environment, including access to necessary facilities and adherence to health and safety standards. HD Plumbing and Gas reserves the right to suspend work if conditions are deemed unsafe.

14. Privacy and Data Use

We may collect and use client data for business purposes, including credit assessments and debt recovery, while adhering to privacy laws. By engaging our services, you consent to these uses.

15. Disputes and Disputed Invoices

Should an invoice dispute arise, please notify us immediately. We aim to address issues promptly to maintain positive client relationships.

16. Governing Law and Jurisdiction

These Terms of Trade are governed by New Zealand law. Any disputes shall be resolved in accordance with New Zealand law.

17. Modifications and Amendments

These Terms of Trade may be updated periodically. The most recent version will be provided upon request and apply to all ongoing and future services.

18. Entire Agreement

This document constitutes the full agreement between HD Plumbing and Gas and the client. Any additional agreements must be in writing and signed by both parties.

19. Client Acknowledgment

By confirming a job with HD Plumbing and Gas, you acknowledge that you have read, understood, and agreed to these Terms of Trade. We appreciate your business and look forward to providing you with high-quality, reliable service.
